Company Buy to let

1. Is it better to buy a property personally or through a limited company?

There isn’t a single answer. Buying personally and buying through a limited company can have different tax, lending and administrative implications. The right structure depends on your circumstances, investment plans and how you intend to use the rental profits. It is worth taking professional tax advice before deciding.

2. What is a Special Purpose Vehicle (SPV) for buy to let?

An SPV is a limited company set up specifically for holding and letting property. Many lenders prefer or require limited company buy to lets to be held within an appropriate SPV structure. The permitted company activities and SIC codes can vary between lenders.

3. Can I transfer my existing personally owned property into a limited company?

It may be possible, but transferring a property from personal ownership to a limited company is not simply an administrative change. It can have tax and legal implications and may require a new mortgage. You should take independent tax and legal advice before proceeding.

4. Will I need to give a personal guarantee for a company buy to let mortgage?

Yes, many lenders require directors to provide personal guarantees for a mortgage in a Limited Company.

5. Can a new limited company get a buy to let mortgage?

Yes. A company does not necessarily need a long trading history to obtain a buy to let mortgage. Specialist lenders can consider newly established property companies, subject to their criteria.

6. Can a trading company get a buy to let mortgage?

Yes, but rates tend to be higher as the risk is seen as higher.

7. Can I get a buy to let mortgage on any type of property?

As long as the property will be used for residential accommodation, we are usually able to find a lender for it. Lenders have different criteria covering property type and where it is. Standard houses and flats are generally the simplest, while unusual construction, HMOs, flats above commercial premises and other specialist properties may require specialist finance.

8. Can I get a buy to let mortgage on a flat?

Yes. Flats are commonly financed through buy to let mortgages, but lenders may consider factors such as lease length, service charges, the number of floors, cladding or construction type and whether the property is above or adjacent to commercial premises.

9. Can I get a buy to let mortgage on a property that needs renovation?

Potentially. The answer depends on the extent of the works and the lender. If the property isn’t currently habitable, a standard buy to let mortgage may not be appropriate and specialist refurbishment or bridging finance could be worth considering.

10. Can I buy a property at auction with a buy to let mortgage?

Yes, but HMO lending is generally more specialist than standard buy to let and therefore needs a specialist lender. You are not allowed to let out a property as an HMO on a standard buy to let mortgage.

11. Can I use a buy to let mortgage to buy an HMO?

It can be possible, but not advisable due to the timescales involved with auctions being very restricted.
